1. Subject Matter of the Agreement

Roads Of Joy (hereinafter referred to as the "Agent") arranges travel services (e.g. flights, hotels, rental cars, transfers, tours) between the customer and the respective tour operator or service provider. The Agent is not a contractual party to the travel services provided.

2. Conclusion of Contract

By making a booking, the customer instructs the Agent to arrange a travel service. The Agent accepts this instruction by confirming the booking. The contract for the travel service is concluded exclusively between the customer and the service provider.

3. Duties of the Agent

The Agent undertakes to process the booking with the due diligence of a prudent business person. The Agent does not guarantee the conclusion of a contract with the service provider.

4. Payment

Payments are made, as agreed, either directly to the respective service provider or via a booking platform such as FORA Travel. If payment is processed via the Agent or a platform, the payment terms of the respective provider apply. The Agent is authorized to receive payments on behalf of and for the account of the service provider, provided this has been agreed.

5. Cancellations and Changes

Cancellations or changes to bookings are subject to the terms and conditions of the respective service provider. The Agent does not charge any service fees for such transactions.

6. Liability

The Agent is not liable for the proper performance of the arranged travel services. Liability is only accepted for intent or gross negligence in the mediation process. In the case of slight negligence, the Agent is liable only for breach of essential contractual obligations (cardinal duties), and limited to foreseeable damages.

7. Travel Documents

The customer is obligated to check the travel documents received for correctness and completeness immediately and must notify the Agent of any discrepancies without delay.

8. Passport, Visa, and Health Regulations

The customer is responsible for complying with all passport, visa, customs, and health regulations. The Agent provides this information to the best of their knowledge but does not assume liability for compliance.

9. Data Protection

The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). Further details can be found in the separate Privacy Policy.

10. Applicable Law and Jurisdiction

German law applies. The place of jurisdiction, insofar as legally permissible, is the registered office of the Agent.
